Lawsuit Filed Against Hospital

One year ago at Eastern State Hospital, patient Duane Charley was murdered while in his hospital room.  He was found beaten and strangled to death.  The next morning, another patient, Amber Roberts, informed hospital staff that she had murdered someone.  Roberts was being housed indefinitely at the Hospital and had been determined legally insane.  Several claims were made in the wrongful death lawsuit, filed in federal court.  One claim accuses the Hospital of allowing patients in the criminally insane ward to “freely roam…at all hours of the night.”  In addition to that, the suit claims that the Hospital also failed to safely store items that could be used to hurt or kill patients by “violently insane patients.” According to the suit, the Hospital is allegedly has “deficient policies and practices, among other failures, that allowed patients to freely enter patients’ rooms at all times of the day and night, and failed to restrict patients’ access to cords and other strangulation devices.”  Wrongful death lawyers for the family also claim in their lawsuit that the Hospital was formally warned in 2006 and in 2009 regarding those issues and were advised to change their practices so they may better protect their patients.  Had they made these changes, Roberts would not have gained access to Charley’s room to commit the murder, especially not in the middle of the night without being detected by staffers.

To make any changes to patient safety policies, the Hospital had to be threatened with losing their accreditation and funding.  The purpose of this wrongful death lawsuit is to push the Hospital to review their policies and make changes so that incidents like this do not happen in the future.  The wrongful death lawyers stated that the Hospital “has shown itself unwilling to voluntarily correct the many problems posed by its lax policies towards patient safety and supervision.”

AEG Live Wrongful Death Trial in 15th Week

Michael Jackson’s mother and three children are suing the company for wrongful death because they feel the compnay is responsible for hiring Dr. Conrad Murray as Michael Jackson’s doctor.  According to CNN, the lawsuit contends that AEG Live was liable for Jackson’s death because they negligently hired and supervised Dr. Murray during the time he was working for Jackson.  An attorney for AEG Live, Kathy Jorrie, is responsible for negotiating Dr. Murray’s contract for employment.  During contract negotiations, Dr. Murray revealed to Jorrie that, in order to take the position, he would have to close several medical clinics which were bringing in $1 million per month.

A Los Angeles Police detective testified in this civil trial that Murray’s debt was in excess of $1 million and Murray’s Las Vegas medical clinic was facing being evicted in the months prior to being hired to treat Jackson while on tour.  During his criminal trial, Murray told investigators that he gave Jackson infusions of the anesthetic propofol each night for two months for treatment of his insomnia. The coroner ruled Jackson died from a propofol overdose on June 25, 2009.  Murray is currently serving a prison term for involuntary manslaughter.

The wrongful death attorney for Jackson is arguing that “AEG Live executives were negligent because they failed to check Murray’s background, which they contend would have revealed his debts and misrepresentations about his successful practices.”  An expert on music industry contracts also testified that AEG’s negotiations with Murray were “highly inappropriate.”  He further testified that AEG Live executives should have recognized there could be an issue with Murray when he initially asked for a $5 million-one year contract as Jackson’s doctor. “That is a pretty bizarre amount,” he said.

In opposition of this, AEG Live executives have tesified that Jackson assured everyone that Murray was his “longtime personal doctor.”  This is the reason, AEG claims, that Murray was found competent for the tour position.  AEG is also attempting to make Jackson out as a drug addict, saying that it was impossible for them to know what danger Jackson’s life was in prior to the tour beginning.

However, a red flag still waives due to the large amount–$150,000 per month–that AEG was paying Murray for his services because the company was aware that there was another doctor who was willing to accept $40,000 per month for the same position.
