Drunk driving is unfortunately a common occurrence in the State of South Carolina.  According to the United States Census Bureau there were 894 fatal traffic accidents in South Carolina in 2009, 377 of which occurred when the driver of the at-fault vehicle had a blood alcohol level of 0.08 or higher.  Under S.C. Code Ann. § 56–5–2950(G)(3), if any driver’s blood alcohol content (BAC) is 0.08 or higher it is presumed that they are operating the vehicle under the influence of alcohol.
